
Google requests the European Union's highest court to uphold the ruling that annulled the $1.7 billion fine

Google on Wednesday appealed to the European Union's highest court, seeking to uphold a 2024 lower court ruling that overturned a €1.49 billion (approximately $1.7 billion) antitrust fine imposed on Google by the European Commission.
The core dispute of the case revolves around Google's AdSense advertising business. In 2019, the European Commission found that Google abused its dominant position in the search advertising market by imposing restrictive clauses in contracts with publishers, preventing competitors from placing search ads on publishers' websites, a practice that continued until 2016.
In response, Google's lawyer Josh Holmes countered the European Commission's arguments at a hearing in Luxembourg, claiming that its "new arguments are flawed" and insisting that the lower court's reasoning for overturning the fine was "clear and complete." He emphasized that the European Commission ignored evidence showing that Google's competitors had ample opportunities to compete in the market.
On the other hand, European Commission lawyer Anthony Dawes accused the lower court's ruling of being erroneous, arguing that its regulators took on an unprecedented obligation in analyzing key issues that had already been resolved by case law, effectively "overturning precedent."
Google is currently involved in multiple lawsuits with the EU. Just this week, the EU court dismissed Google's appeal against another €4.1 billion antitrust fine related to Google's Android system monopoly. In the AdSense case, the Chief Legal Officer is set to issue a non-binding opinion on November 12, with a final ruling expected in the following months
